Agreement to these terms

These Terms of Service govern your access to and use of valenrove.com and purchases from VALENROVE. By using the website or placing an order, you agree to these terms, our Privacy Policy, and any policy or product-specific terms linked on the site. If you do not agree, do not use the site or place an order.

VALENROVE is operated by Arbor Restore LLC, 4355 Imperial Ave, San Diego, CA 92113, United States.

Eligibility and account information

You must provide accurate, current information when placing an order or creating an account. You are responsible for maintaining the confidentiality of any account credentials and for activity occurring under your account.

Product information and availability

We aim to present products, colors, dimensions, prices, and availability accurately. However, screen settings may affect color appearance, and handcrafted, textured, or outdoor-use materials may have minor variations. Unless a product page states otherwise, dimensions are approximate and may have reasonable manufacturing tolerances.

Product images are for illustration. Accessories, plants, tools, and decor shown in lifestyle images are not included unless specifically listed in the product description.

We may change, discontinue, limit, or update products, pricing, promotions, and availability without notice. We reserve the right to correct errors, inaccuracies, or omissions, including after an order has been submitted.

Orders and acceptance

Submitting an order is an offer to purchase. An order confirmation does not mean that we have accepted the order. We accept an order when we confirm shipment, unless we notify you earlier that the order has been accepted.

We may refuse or cancel orders for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment authorization problems, address issues, or violation of these terms. If payment has been captured for a canceled order, we will issue an appropriate refund.

Product use and care

Use products only for their intended household purpose and follow all product instructions, warnings, assembly directions, weight limits, and care guidance. Outdoor conditions vary. Customers are responsible for appropriate installation, placement, routine maintenance, seasonal storage, and securing products against wind, weather, children, pets, and other foreseeable hazards.

Do not use planters, stands, storage products, side tables, trays, or garden accessories as ladders, seats, climbing equipment, toys, or for purposes not described on the product page. Keep packaging materials away from children and pets.

Shipping, returns, and cancellations

Our Shipping Policy, Return and Refund Policy, and Order Cancellation and Change Policy are incorporated into these Terms of Service.

Intellectual property

The VALENROVE name, website content, product descriptions, text, graphics, photographs, logos, designs, and other materials on the site are owned by or licensed to Arbor Restore LLC and are protected by applicable intellectual-property laws. You may not reproduce, distribute, modify, display, or commercially exploit site content without prior written permission.

Prohibited conduct

You may not misuse the website, interfere with its operation or security, submit false or fraudulent information, attempt unauthorized access, use automated tools to scrape the site without permission, infringe another party's rights, or use the site for unlawful purposes.

Disclaimer of warranties

To the fullest extent permitted by law, the website and products are provided on an "as is" and "as available" basis, except for any express written warranty provided with a product. We do not warrant that the website will be uninterrupted, error-free, or completely secure, or that product results will be identical in every outdoor environment.

To the fullest extent permitted by law, Arbor Restore LLC and VALENROVE will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the site or products. Our total liability for a claim relating to a purchase will not exceed the amount paid for the product giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Arbor Restore LLC, VALENROVE, and their owners, employees, contractors, and service providers from claims, losses, liabilities, and expenses arising from your misuse of the website or products, violation of these terms, or violation of applicable law.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute will be resolved in the state or federal courts located in San Diego County, California, unless applicable law provides a different forum or procedure.
